Roberts said he had never heard evidence that the policeman who shot Babbit had shouted her a stop order, and said it was not clear to him whether Babbit had even seen the policeman. ..
“On her side of the door, it’s pretty noisy, you know-a lot of noise and everything,” Roberts said. “I don’t think Ashli Babbitt saw him at all, which means that if she saw a policeman with a gun pointing at her, I think it would be something else.”
Roberts said in his view, and in the Babbitt family’s view, that Babbitt was a protester trying to exercise her rights to relieve dissatisfaction from her government. “We don’t shoot protesters in this country unless you know they are an imminent threat to someone,” Roberts said. “So I can’t tell the difference between the Ashli Babbitt case and the other protests that took place in 2020.”

Twitter then deleted Babbitt’s previous @Ashli_Babbitt account, but her posts can be seen on the Wayback Machine in the Internet Archive with screenshots saved before the deletion.
The archive of her account on Wayback Machine retweeted Trump’s lawyer L. Lin Wood dozens of times in the days leading up to the joint session of the United States on January 6. “Children’s rape and murder.”
The archives show that a few hours before the riot, Babbit retweeted another Wood post and asked Vice President Mike Pence to resign and be charged with treason.
Roberts did not say when the Babbitts could file a proceeding, but said he promised to hold police accountable.
“The only way we can do that is through a civil lawsuit seeking damages,” Roberts said. “That is, you are married and you are killing someone with a family. That can be very damaging.”
US Capitol Police said Tuesday that the ministry could not comment on the proceedings in dispute. A spokeswoman said the police officer who shot and killed Babbitt remained on paid leave for the duration of the internal investigation. This is the standard procedure for shooting involving police officers.
Babbit survived by her parents and her husband, Aaron. And she ran a pool cleaning business.
