Kansas City, Kansas (AP) — A federal judge has dismissed a proceeding filed by Audubon, Kansas over water rights in the Kibira Wildlife Sanctuary in central Kansas.
Audubon sued the US Interior Ministry and other federal and state agencies in January.
Environmental groups claimed that government agencies did not protect senior water rights in shelters.
Judge Holly Teater of the U.S. District Court ruled that Audubon did not have jurisdiction over the federal court to file a claim against a state entity and did not identify a proceeding that would allow it to sue a federal agency. ..
The proceedings alleged that Quivera was running out of water because irrigators were pumping groundwater upstream.
