Federal Judge Richard Heltling supports the defense in a ruling and completes a month-long battle After Blue Origin sued NASA in August..
NASA said in a statement that cooperation with SpaceX would resume “as soon as possible” given the ruling.
“There will be an opportunity for companies to partner with NASA to establish a long-term human presence in the month under the agency’s Artemis program,” the agency added.
A Blue Origin spokesperson said in a statement to CNBC that the company’s proceedings “revealed important safety issues regarding the procurement process for human landing systems that still need to be addressed.”
“Safely returning astronauts to the moon through NASA’s public-private partnership model requires an unbiased procurement process, along with sound policies that incorporate redundant systems to promote competition. BlueOrigin is an Artemis program. We continue to work deeply on our success, “said the company.
SpaceX did not respond to requests for comment on the decision. Musk posted a photo of the 2012 movie “Dredd” in a tweet in reply to a report on CNBC’s decision.

SpaceX was competing with Blue Origin and Dynetics for what was expected to be two contracts. Since then, NASA has awarded only one contract because Congress has assigned less to the program than expected.
Blue Origin immediately protested the decision with the U.S. Government’s Accountability Department, GAO denied company complaints in late July – Lead the Bezos space company to escalate legal action. Bezos is also the founder of the e-commerce giant Amazon.
Edited version of the Blue Origin proceedings NASA erroneously granted a contract only to SpaceX, revealing the company’s complaint focused on proving that it “ignored key flight safety requirements” in the process.
Hartling’s ruling dismissed Blue Origin’s allegations. The court’s opinion is currently sealed because the proceedings contain company-specific information, but the parties have been ordered by Hertling to submit an amendment by November 18 and have published their opinion. ..
NASA’s work with SpaceX on the HLS contract was suspended during the proceedings and will resume on Monday.
