ST. Paul, Minnesota (AP) —American Dairy Queen Corp. has lost a federal proceeding in a Massachusetts company for trademark infringement for naming bottled water “Blizzard.”

Star Tribune reported Friday, when Susan Richard Nelson, US District Judge in St. Paul, Minnesota, issued a written decision earlier this month. The judge said Dairy Queen, based in Bloomington, could not prove that WB Mason had committed the infringement.

Dairy Queen is dubbing the soft serve ice cream treat Blizzard and has retained the trademark of its name since 1946.

According to court documents, WB Mason Co., which sells some food and beverages, launched a line of copy paper named Blizzard in 2003 and named it bottled water in 2010. I attached it. The Dairy Queen proceedings demanded that the company remove Blizzard water from store shelves and sought unspecified damages.

WB Mason Co.’s lawyer said Dairy Queen noticed Blizzard’s springs in 2017 and couldn’t show any confusion after nearly 190 million bottled water sales. Insisted.
