His arrest warrant for abstaining from parole, which had been carried out for previous convictions on several felony and misdemeanor charges, had a positive warrant. He was also armed and considered dangerous and was with an adult female in his residence.

EPSO’s tactical support group, consisting of SWAT, K-9, Colorado Springs Fire Department tactical medical care, tactical dispatchers, explosive ordinances, and crisis negotiators, has responded to the scene.

Containment was established around the house, and negotiators attempted to communicate to ensure the peaceful surrender of the suspect. Both Garduno and the female refused to leave. The woman was determined not to be detained against her will.

Due to the refusal to drop out peacefully, Talbot Elementary School was initially placed in a “lockout” state, after which the students were released to their parents through a controlled release. At this time, residents within a 0.25 mile radius of the scene were asked to evacuate to their designated location.

After unsuccessful efforts by negotiators to persuade Garduno and the women to leave peacefully, the SWAT team eventually deployed non-fatal gas bullets into their homes and expelled them. At around 5:30 pm, Garduno left home and was detained.

He was taken to El Paso County Jail and booked. After a while, the woman left home and was treated on-site because she was exposed to gas bullets.
