Theranos’ former CEO lawyer cites widespread negative coverage as a reason for expanding jury candidates in her next criminal fraud trial.

The 21-page allegations filed late Thursday provided examples of very descriptive and boring stories about Holmes over the past few years.

In a court filing, Holmes’ lawyer said he had a comprehensive search for news articles and other media that generated 462,000 entries. Of these, 3,755 were “negative personal news” and 2,862 were “negative business news.”

Holmes’ lawyer proposed a 46-page jury survey covering topics ranging from blood testing and work in the medical industry to experience in the venture capital world.

The survey also asks if the jury candidate has been a victim of fraud, had a bad investment experience, or was involved in a misdiagnosis controversy.

Holmes dropped out of Stanford University at the age of 19 and founded Theranos. The technique claimed that only one or two drops of blood could accurately perform thousands of tests. Former executives have pleaded not guilty to 12 telegraph fraud charges in connection with misleading patients and investors.

The judge set up a pretrial hearing on June 15. The jury election is scheduled to begin on August 31st in San Jose.
