Las Vegas (FOX5)-The judge has decided not to dismiss the accusation against Zaon Collins, who was accused of killing a man in a fatal drunk driving accident.
Collins lawyers David Chesnov and Richard Schoenfeld confirmed that Judiciary Susan Baucam denied the lawyer’s request to dismiss the indictment on Monday. Chesnov and Schoenfeld have filed a motion to dismiss Marijuana’s drunk driving charges against him because of ongoing legislative measures and that Collins may not have been negligent in the crash.
“We will appeal because we believe the court order has a gap between the facts used to reach the results and the legal analysis,” the lawyer said in a joint statement. “These issues are too important for the Nevada people to be left without further review.”
Collins was accused of killing Eric Eschvaria in a crash near Fort Apache Road and Furnisgarcia Avenue on December 30. According to the arrest report, Collins was traveling 88 mph in the 35 mph zone at the time of the crash.
According to court records, Collins’ next hearing was set for July 29.
