Justices limit 2020 ruling on tribal lands in Oklahoma – Colorado Springs, Colorado

Washington (AP) —The Supreme Court has ruled that if the victim is Native American, Oklahoma can prosecute non-Native Americans for crimes committed on tribal lands.

Wednesday’s 5-4 decision reduced the High Court’s decision from 2020, stating that much of eastern Oklahoma remains an American Indian reservation.

The first decision prevented the state from prosecuting Native Americans accused of crimes on tribal lands, including most of Tulsa, the second largest city in the state with a population of approximately 413,000.

However, the judge said Oklahoma could intervene if the victims were members of the tribe and their accused perpetrators were not.

Judge Neil Gorsuch objected. He was joined by three liberal judges in court.
