Fort Smith, Ark (NewsNation Now) — February 1981, Rolf CastelArmed with a toy water gun and robbed $ 264 at a taco shop in Arkansas. He has been imprisoned for 40 years for that charge.

Kaestel is awaiting a decision by Arkansas Governor Asa Hutchinson on another amnesty claim. The governor has a little over 90 days to make a decision. In 2015, Hutchinson denied Kaester’s amnesty.

Kaestel is part of the Arkansas Corrections Bureau’s Interstate Agreement and is now located in Utah.

According to the website, Kaester has not violated prison rules for 40 years as a prisoner.

He earned three associate degrees and several college credits while in prison.

According to the ADC website, Interstate Compact staff will act as a point of contact between Arkansas and out-of-state offices for transfer, progress reporting, and delivery of oversight with other states. Responsible for processing the initial investigation request.
