At a hearing on Friday, the prosecutor showed the judge a live Facebook video taken hours before the crash.
It shows Martinez drinking alcohol while driving with a child seat in the back.
“The safety of the children in the vehicle and the safety of others on the road were not taken into account,” prosecutor Shonnetta Estrada said in court.
Police officers testified that Martinez was driving nearly 89 mph when he collided with the I-25 barrier near the Big I in March.
Police also testified that they found what looked like heroin in marijuana and Martinez purses.
Martinez’s lawyer called on the judge to release his client, arguing that her serious injury from the crash needed more treatment.
“She is constantly suffering when talking to my client,” said Joe Gribble. “Her injury is serious and MDC is not equipped to receive the necessary aftercare.”
The judge eventually made a preliminary inspection to the prosecution.
“There is no worse drunk driving behavior than entering a highway barrier above 80 mph with a very small child unrestrained in a car. A small acronym that the court can use,” he said.
