Enforcement must be done locally

KOIN, Oregon — Recently, President Biden announced that companies with more than 100 employees would need to require workers to get a vaccine or provide a weekly negative test. Large entertainment venues require regular customers to request a vaccine or negative test.

However, enforcement must be done at the local level. And the Oregon Occupational Safety and Health Administration is deeply involved.

“Generally speaking, once federal OSHA rules are enforced, states like Oregon that have their own OSHA programs will consider state rules that must be at least as effective as the federal version.” Oregon officials told KOIN 6 News.

They added that everything they do in Oregon applies to both the public and private sectors.

The Oregon Department of Health said there was actually no guidance from it, as the Federal OSHA has not created rules to implement this.

For those who already need vaccination, such as teachers, and for workers who are medically or religiously exempt, employer testing may be an option. However, OHA rules do not allow testing instead of vaccination.
