(NEXSTAR) – Vice President Mike Pence will not invoke the 25th Amendment, according to a letter to House Speaker Nancy Pelosi on Tuesday.
In the statement, Pence said, “With just eight days into the president’s term, you and the Democratic caucus are demanding that Cabinet and I invoke the 25th Amendment.” I do not believe that such a course of action is in the best interest of our nation or in accordance with our Constitution.
He said the 25th Amendment “is not a means of punishment or usurpation” and that invoking it “in this way would set a terrible precedent”.
Pence goes on to accuse the House of Representatives of playing “political games at such a serious time in the life of our nation”.
Acknowledging the “tragic events” of the Capitol Storm, he said, “The time has come for us to come together, the time has come to heal.”
Finally, he urges Congress to “avoid actions that would further divide and ignite the passions of the moment,” and asks Congress to “work with us to lower the temperature and unite our country as we prepare to inaugurate President-elect Joe Biden. ”
Pence then said he would do his part “to work in good faith with the incoming administration to ensure an orderly transition of power.”
The 25th Amendment states that the vice president and a majority of the top leaders of executive departments “or any other body like Congress” can provide a statement to Congress that the president “is unable to discharge the powers and duties. of its function ”. At this point, the Vice President would assume the powers of Acting President.
The amendment was proposed after the assassination of President John F. Kennedy. It describes the procedures for replacing the chairman or vice-chairman in the event of death, dismissal, resignation or incapacity.
The amendment was implemented during the Watergate scandal in the 1970s. It helped the process of replacing Spiro Agnew as vice chairman. It also came into play when Richard Nixon stepped down.
