His friend said Wednesday that three tourists from the East Coast of the United States were on vacation in Hawaii after one of them was “mentally” drunk. Alexander Germany-Wald of Montclair, NJ, testified at a preliminary hearing in Benjamin Fleming, a fellow at his university in Pittsburgh. The University of Carnegie Mellon University in Pittsburgh was staying on a vacation rental in Big Island last month when Gupta was asked to leave the bar because he was warlikely drunk, Germany-Wald said. Germany-Wald said he brought Gupta back to their Kailua-Kona Airbnb while Fleming stayed behind. While in the mansion, Wald, Germany, said Gupta was “angry” at him and was trapped in his bedroom. After Fleming returned, Germany’s Wald and Gupta were involved in a conflict. “I also knew I was in serious danger when Gupta was on top of me,” said Wald of Germany. Fleming intervened and detained Gupta, Germany-Wald added that he did not know what hold he used to detain Gupta. Germany-Wald said he was able to hear Gupta’s snoring while drinking beer in the kitchen with Fleming. Fleming called 911 when he noticed that Gupta wasn’t breathing, according to Mr Wald of Germany. Police arrived after the rescue workers said there was nothing more they could do for Gupta. Fleming and Wald of Germany were arrested. Germany-Wald was later released without charge. Before the hearing began, Fleming’s lawyer Christopher Egert asked his client to allow him to change his prison clothes. Egart said he was concerned about prejudice against Fleming as the hearing was broadcast on Zoom. The judge allowed him to change his shirt. “I think it’s a fair request,” said Judge Cynthia Thai, and the hearing was scheduled to resume on Thursday.
