NEW YORK — Harvey Weinstein's lawyers said Saturday that the former movie mogul will return to New York City for a series of tests following an appeals court ruling vacating his 2020 rape conviction. It was announced that he was hospitalized.

His lawyer, Arthur Aidala, said Weinstein was transferred to Manhattan's Bellevue Hospital after arriving at the city jail on Friday.

“They tested him and sent him to Bellevue. Physically it looks like he needs a lot of help. He has a lot of issues and is undergoing all kinds of tests. Health-wise, the train It's like an accident,” Aidala said.

A message left at the hospital was not immediately returned Saturday.

Frank Dwyer, a spokesman for the New York City Department of Corrections, said only that Weinstein remains in custody in Bellevue. Thomas Maley, a spokesman for the state Department of Corrections and Community Supervision, said Mr. Weinstein was turned over to the city's Department of Corrections pursuant to the appeal ruling. Weinstein was being held at the Mohawk Correctional Facility, about 100 miles (160 kilometers) northwest of Albany.

On Thursday, the New York Court of Appeals reversed his conviction, concluding that the trial judge excessively allowed jurors to see and hear evidence not directly related to the charges he faced. The court also canceled his 23-year prison sentence and ordered a retrial.

Prosecutors said they would retry him on charges of forcing oral sex on a television and film production assistant in 2006 and raping an aspiring actor in 2013.

Mr. Weinstein remained in custody after his appeal, having been convicted in Los Angeles in 2022 on a separate rape charge and sentenced to 16 years in prison.

For some time, Weinstein suffered from various ailments, including heart problems, diabetes, sleep apnea, and eye problems.

Aidala said she spoke to Weinstein on Friday afternoon while he was being transferred from an upstate prison to New York City, less than 24 hours after the appeal decision was announced Thursday morning. Ta.

He said his client's illness was physical, adding that mentally he was “sharp as a tack. His feet are firmly planted on the ground.”

Lawyers say it typically takes one to two weeks for the state Department of Corrections and prison officials to arrange for a prisoner's transfer.

“He wasn't treated well. They refused to give him even a sip of water, they didn't give him food, they didn't give him bathroom breaks,” Aidala said. “He is a 72-year-old sickly man.''

Maley, the state corrections spokeswoman, did not comment on a phone call reading Aidala's statements about Weinstein's treatment.

Aidala said she was told that doctors at Bellevue planned to perform a number of tests on Weinstein before returning him to Rikers Island.

The lawyer said he plans to meet with Mr. Weinstein on Monday. He added that when Mr. Weinstein appears in a Manhattan courtroom on Wednesday, he plans to tell the judge that the retrial should take place after Labor Day.
